Council Minutes – January 14, 2008

(These minutes will require approval/adoption at the next regular session of Council, scheduled for January 29, 2008)

 

Council met in regular session Monday January 14, 2008 at 7:00 p.m. at Mountain Grove.

 

Present:            Mayor, Janet Gutowski

                        Deputy Mayor, Bob Harvey

Councillors: Normand Guntensperger, Jeff Matson, John Purdon, Gary Smith, Phillip Smith and Bob Harvey, Frances Smith

 

Staff in attendance: John DuChene, Judy Gray, and Cathy MacMunn

Also in attendance: Craig Bakay – Gazette Reporter and Jeff Green – Frontenac News Reporter

 

A Public Meeting (for the purpose of receiving planning reports and public input under the Planning Act) preceded the regular Council session.

 

A planning report for Fosnough (Part Lot 6, Conc.2 Oso District) was then presented to Council and those in attendance by David Sappleton of Tunnock Planning Consultants Ltd.

 

Following the presentation, the Mayor asked if there were any persons in attendance wishing to speak in favour or against the proposal. There were no comments or questions received.

That the recommendations of the Planning Report for the FOSNOUGH rezoning proposal be accepted and further, that staff is directed to prepare a draft amending zoning bylaw for consideration at the next regular meeting of Council.

A second planning report for Neill (Part Lot 19, Conc. 3, Hinchinbrooke District) was then presented to Council and those in attendance by David Sappleton.

 

Following the presentation, the Mayor asked if there were any persons in attendance wishing to speak in favour or against the proposal. Mr. Neill was in attendance and he supported the proposed rezoning.

That the recommendations of the Planning Report for the NEILL rezoning proposal be accepted and further, that staff is directed to prepare a draft amending zoning bylaw for consideration at the next regular meeting of Council.

The Council agenda was then introduced. The Clerk requested that the agenda be amended by adding “Committee/Agency Appointments” under Reports (Clerk-Administration) as 8(j)(i).

That the agenda for the January 14, 2007 meeting be adopted as amended.

The Mayor requested if any members of Council wished to declare conflict regarding the agenda items to be discussed.  Councillor Matson declared potential conflict with item 8(c) Accounts Payable.

 

The Minutes of December 10, 2007 were then introduced.

A typing error was identified for resolution #507 (word “how” to read “now”)

That the minutes of the December 10, 2007 Council meeting be adopted as corrected.

Discussion of the Official Plan was then introduced.  Provincial representatives in attendance included Cam McCauley, Biologist - MNR , Alida Mitton, Planner - MOE
Victor Castro, Group Leader -Surface Water – MOE, Laurie Miller, Planner, MMAH
and Joe Gallivan, Senior Planner MMAH.

MNR and MOE provided a short presentation on "At-Capacity Lake Trout Lakes" to help explain the province’s policy in designating trout lakes at risk.  In the case of Central Frontenac four lakes have now been categorized as “At-Capacity”.  These lakes include Sharbot Lake - West Basin (existing), Silver Lake (existing), Crow Lake (new) and Eagle Lake (new).

A general discussion (questions/answer period) followed this presentation.

 

In addition to the recommended Minister’s modification regarding At Capacity Lake Trout Lakes, two additional proposed Minister’s modifications were introduced for discussion; i.e., Sewage Disposal/Septic Setbacks and Vegetation Buffers.

            That the Ministry’s proposed modification 6 (a) be rejected and the modification             read “Reduction of the 30 m [98.4 ft.] setback for a subsurface sewage disposal             system should only be permitted where site conditions (e.g. topography, a right-    of-way or private road bisecting the lot, soil conditions) preclude the reasonable             possibility of achieving the prescribed setback”.

            That the Ministry’s proposed modification 7 (b) be amended to allow setbacks of             accessory structures as the average setback of adjacent properties provided the             minimum is 15 m [49.2 ft.].

            And further that wording changes in Sections 3.6.5.B and 3.7.10 be made by        adding the following to the end of each of those sections respectively. “However,             shoreline structures may be setback a lesser distance where there is an established             building line provided that the average setback is not less than 15 m [49.2 ft.].”

Unfinished Business was then introduced.

That the Draft report of the Waste Management Committee dated January 2, 2008 be received for consideration (to be discussed in more detail at the next Council Session) and further, that staff be directed to prepare an RFP (Request for Proposal) to initiate implementation of recommendations #5 and #6 regarding the purchase of waste management bins and related transportation services.

That Council for the Township of Central Frontenac approve the Accounts Payable Reports dated Dec. 11, 2007 ($63,025.24); Dec. 17, 2007 ($763,959.77), Dec. 21, 2007 ($430,027.44) and January 4, 2008 ($98,949.80).

That Council for the Township of Central Frontenac approve the following reduction of Assessments pursuant to the Municipal Act.

Roll # 10 39 010 010 10950 (Tineke Hollestelle) in the amount of 27,000 for June 1, 2007 to Dec. 31, 2007 – reason mobile unit removed.

Roll # 10 39 070 020 18800 (Central Frontenac Twp.) property class changed to exempt for tax sale property vested to the municipality.

And further, that Council approve an adjustment of taxes to be calculated by the tax department for the related period.

Expenditures to Budget for the period ending November 30, 2007.

That the Mayor and Clerk be authorized to execute an agreement between Ross Dubeau and Yvonne McCullough and the municipality for the purpose of ensuring maintenance of any sewage disposal system to be constructed on lands described as part of Lot 1, Concession 3, being part 1 on plan 13R-19024, in the former geographic Township of Kennebec, now in the Township of Central Frontenac.
