COUNCIL MINUTES – October 11, 2005
Council met in regular session, October 11, 2005 at 9 a.m., at the Community Hall, Mountain Grove.
Present – Mayor, Bill MacDonald
Deputy Mayor, Faye Putnam
Councillors – Bill Guigue, Bob Harvey, Janet Gutowski, Logan Murray,
Jack Nicolson, Frances Smith, & Bill Snyder.
Also in attendance – Cathy MacMunn – Deputy Clerk, Jeff Green – Frontenac News Reporter & Kristina Chryssanthis – Gazette Reporter.
There were no disclosures of pecuniary interest when the Mayor called for same.
Art Dunham & Terry Kennedy attended to discuss the release of parcel mapping as a contractor pursuant to the MPAC Agreement.
Peter May attended to ask Council to waive the rules of the policy regarding the Waste Disposal Site free disposal ticket.
Jennifer Tryon attended to request Council to waive the No alcohol policy on public beaches.

The following resolutions were presented.

That the Agenda of October 11, 2005 be adopted as amended, item #12 will be moved after 5(a).

That the minutes of September 27, 2005 be adopted as circulated.

That the rules of the policy established by Council that a free dump pass would not be issued, be waived and the request from Peter May be approved, and that this pass be honoured before October 25, 2005. Carried.

That the rules of the policy not to allow alcohol on public beaches be waived and the request from Jennifer Tryon to have a liquor license for a wedding on the beach be approved subject to the provision that Ms. Tryon provide adequate insurance as prescribed by the township’s insurance provider and perhaps a different location at the beach to be approved by Township.

That motion #400 dated November 23, 2004 be rescinded.

Whereas: communication on water quality issues has been stressed as important by the majority of the Lake and Cottage associations in Central Frontenac.
Whereas: MPAC had advised that mapping information can be supplied on a contractual basis.
Whereas: Volunteerism has been stressed as the essential element in building strong environmental stewardship organizations by the Ontario Government and Conservation Ontario.
And Whereas: Volunteer organizations need the tools to complete the important job of maintaining water quality and a healthy natural environment.
Be it resolved that: the Municipality of Central Frontenac enter into a contractual agreement with FEP to provide mapping data necessary to the Community Environmental Partnership application, and it’s successful launch as a strong tool for environment stewardship.
That the contract would be prepared by the township solicitor

That the request from the Land O’Lakes Communication Network to re-negotiate the lease for 6 months be approved and a monthly rental fee established at $200.00 less than present balance of lease/month.

That the accounts payable dated September 30, 2005 in the amount of $31,569.54 be approved.

That the November, 2005 meeting dates be scheduled as November 14th and November 29.

That the Council of the Township of Central Frontenac approve the reduction of assessment in the amount of $18,800 for Roll Number 1039 010 020 08305 pursuant to Section 357 and 358 of the Municipal Act and further that Council approve an adjustment of taxes for 2004 and 2005.

That the staff advancement on the salary grid report dated October 4, 2005 from the clerk-administrator be received and the recommendations approved.

That the letter from Kathy and Noel Bateman regarding the structure adjacent to the Parham Post Office property be received and a letter be sent as per the status of the structure.

That the Township of Central Frontenac strongly objects to the request of architects and engineers for exemption from Bill 124; and further request that the Building advisory Council to be set up in January 2006 address the following issues regarding liability recommended by BRRAG but omitted in Bill 124 – improved Code knowledge for builders/contractors, provisions for builder liability insurance for non-residential builders, and longer liability insurance periods for designers; and further that BAC review the other recommendations of BRRAG that were omitted in Bill 124 which will create a more equitable building regulatory system in Ontario.

WHEREAS the Provincial Standing committee on Regulations and Private Bills is currently debating Private members Bill 123 the Transparency in Public Matters Act; and
WHEREAS the proposed legislation includes municipal council and committees; and
WHEREAS the proposed legislation adds requirements to notice provisions, open meetings, minutes, forms of meetings, among other matters all of which are addressed in the Municipal Act, which would create confusion for council, administration and the public; and
WHEREAS the Municipal Act is currently under review and is being informed by input from the municipal and private sectors among others; and
WHEREAS AMO and others have urged the Standing Committee to remove any reference to municipal councils or council committees from their legislation and allow transparency and accountability issues to continue to be regulated under the Municipal Act;
THEREFORE BE IT RESOLVED that the Township of Central Frontenac urges the Minister of Municipal Affairs and Housing to vote against the Bill if the reference to “municipal councils” is not deleted in the Bill as reported by the Standing committee; and that Leona Dombrowsky, MPP and all provincial members of the legislature be advised of the lack of this council’s support for the inclusion of ‘municipal councils’ in Bill 123.

That the report of the Livestock Valuers for loss of livestock to wolves or coyotes for Ken Shepherd be received and approved and the loss of livestock to a dog for Ralph Insley be approved and compensation be received from the owner of the dog.

That the tender of Crain’s Construction Limited in the amount of $44,600 for final cover topsoil and hydro seeding of Wilkinson Waste Disposal Site be awarded.

That By-law #2005-193, being a by-law to prohibit domestic animals on any public beach within the Township of Central Frontenac be read a first and second time.
