COUNCIL MINUTES – November 14, 2005
Council met in regular session, Monday November 14, 2005 at 7 p.m., at the Community Hall, Mountain Grove.
Present – Mayor, Bill MacDonald
Deputy Mayor, Faye Putnam
Councillors – Bill Guigue, Janet Gutowski, Bob Harvey, Logan Murray,
Jack Nicolson, Frances Smith, & Bill Snyder.
Also in attendance – Heather Fox - Clerk-Administrator, Jeff Green – Frontenac News Reporter & Kristina Chryssanthis – Gazette Reporter.
There were no disclosures of pecuniary interest when the Mayor called for same.
Paul Chaves, President of Garrison Shores Association attended to discuss the time frame for a report from the Planning Consultant as authorized by Council resolution. Planning Consultant, Glenn Tunnock was present and addressed the Garrison Shores property owners in attendance and indicated he was aiming for mid December for submission to Council.

The following resolutions were presented:

That the agenda of November 14, 2005 be adopted as presented.

That the minutes of the October 25, 2005 be adopted as amended.

#416 Frances Smith, Bob Harvey.
That Paul Chaves, President of Garrison Shores Property Association, be thanked for his presentation to Council and that staff be instructed to contact the Township Solicitor and Planning Consultant for a time frame and up-date on the resolution passed by Council on May 2, 2005.

That building permit no. 1-149-1101 be revoked in accordance with s.(10)(c) of the Ontario Building Code Act, and the owner be instructed to take measures to come once again into compliance with the Building Code Act.

That Council continue to support the concept of a Railway Museum/Library complex and that a building design stamped by an Architect and a Professional Engineer be submitted to determine building, septic and parking requirements can be met; and that a feasibility study and/or business plan be submitted to determine the maintenance and upkeep costs of the facility before a commitment to assume ownership; that should the township assume ownership every attempt will be made to continue to maintain the complex as a Railway Museum/Municipal Library; and that the committee elaborate, through a business plan, the request to maintain autonomy over the museum and Collection; that ownership of the municipal land remain with the township and the possibility of a lease agreement be explored if necessary; and since the deeds and plans indicate that the land the township purchased from K & P only includes a portion of the site of the old station, possible alternate locations be investigated.

That the letter from Eric Wagar regarding outdoor wood furnaces be received and that Mr. Wagar be advised that the installation of an outdoor wood-burning furnace is considered a material alteration to the heating system of a house, and as such, a building permit would be required to install one. As this furnace is part of a system of a building the setback from property lines for the furnace would be the same as the required for the building it serves. These setbacks at present are 3m from the interior side line and 7m from the front and rear lot lines in rural zone. There are no zoning or other by-law restrictions relating specifically to outdoor wood-burning furnaces or other solid fuel fired appliances in general.

That the request form Inky Mark, M.P. for the Township of Central Frontenac to pass a resolution to request that the Government of Canada enact Private members Bill C391, the Heritage Hunting and Fishing Protection Act to protect in Canada the right to hunt and fish. No law of Canada shall be construed or applied so as to deprive a person of this right and the Minister of Canadian Heritage shall enter into discussions with the provinces with a view to securing on behalf of all Canadians their continued right to hunt and fish, subject only to any reasonable limits as may be established by by-law be approved.

That the request from the Canadian Union of Postal Workers for the Township of Central Frontenac to pass a resolution to write to John McCallum, the Minister Responsible for Canada Post and request that the federal government instruct Canada Post: 1. to stop the closure of the mail sorting plant in Quebec City and proposed closures in other locations; 2. to consult with the public, postal unions and other major stakeholders to develop a uniform and democratic process for making changes to the Canada Post’s network; 3. to maintain, expand and improve our public postal network, be approved.

That the invitation from the Central Frontenac Fire and Emergency Services District 4, Firefighters Association to participate in the Santa Claus Parade on Sunday, December 4th, 2005 be received and accepted.

That the invitation from the Sharbot Lake and District Lions Club to participate in the Central Frontenac Santa Claus Parade on Saturday, December 3, 2005 be received and accepted.

That the request from the Ontario Federation of Snowmobile Clubs to proclaim the week of November 21 to 27 as “Get Ready for Snowmobiling Week”, be received and approved.
Carried.
#425 Frances Smith, Bill Guigue
Pursuant to Section 217 of the Municipal Act, Council will hold a public meeting and give public notice of its intention to pass a by-law to reduce the size of Council to 1 member per electoral district (4 in total) plus the Mayor elected at large. The date of the public meeting shall be established as Tuesday, November 29 at 9:00a.m.

That Council approve acceptance of donations towards the Walking Tour Brochure, and issue receipts accordingly. Any donations received by the Township for this project shall be forwarded to the organizers of the Brochure production, Shirley Peruniak and Sandra Moase.

That tender #05-11 for the construction of a change room facility at the Tichborne Rink be awarded to Charles in Charge & Co. subject to re-negotiation of the tender.

That by-law #2005-180, being a by-law to formulate a plan for protecting property and the health, safety and welfare of the inhabitants of an emergency area within the Township of Central Frontenac be read a first and second time.
Carried.

That by-law #2005-180, being a by-law to formulate a plan for protecting property and the health, safety and welfare of the inhabitants of an emergency area within the Township of Central Frontenac be read a third and final time and passed.
