COUNCIL MINUTES – March 14, 2005
Council Met in regular session Monday, March 14, 2005 at 7:00 p.m. at the Community Hall, Mountain Grove.

Also in attendance Heather Fox Clerk-Administrator, Jeff Green – Frontenac News Reporter & John Chambers – Gazette Reporter.
Three members of the public attended.
There were no disclosures of pecuniary interest when the Mayor called for same.
Ian Trickett attended to discuss the proposed washroom facility at Sharbot Lake Beach.

That the request from Cindy Steele on behalf of the North Country Riders to use the Parham Fair Grounds to host horse club shows on June 12 and September 18, 2005 be approved subject to provision of liability insurance, acknowledgement that any trucks and trailers be parked on the east half of the fair ground and clean up after the horses be completed.

That the report from KPMG to confirm and update the mutual understanding of the terms of their appointment and increase of $500.00 due to the revised auditing standards for fraud issued by the Canadian Institute of Chartered Accountants, be received and acknowledged and the Mayor and Clerk authorized to sign same.

That the request from the County of Frontenac to appoint a representative to a working committee, as a result of their successful application in securing $10,000.00 from the Community Investment Support Program (CISP) to finance the first step in the process to attract business investment and employment opportunities in the County, be received and that Janet Gutowski be appointed to the committee and Logan Murray as an alternate.

That the caretaker contracts be renewed for 2005 at the original tendered rate as follows: Bernard Brown (Piccadilly Hall) - $130.00/mo., Clarke Gaylord (Kennebec Community Hall) - $390.00/mo., Boyce Fox (Mountain Grove Facilities) – $525.00/mo., Boyce Fox (Bull Lake) - $250.00/season, Dennis Scott (Parham Ball Field, Eagle Lake Landing) - $2,350.00/season, Reg Peterson (Henderson Hall, Fire Hall) - $360.00/season, Dennis Scott (Sharbot Lake Facilities) - $9,875.00/season, Dennis Scott (Sharbot Lake Grounds) - $8,489.50/season, Dennis Scott (garbage pick up) Kennebec District Beach - $2.45/bag. Scott’s Snowplowing (grass cutting) Kennebec District - $3.900.00/season, Ralph Babcock (cemetery $29,480.00 plus $170.00 per winter grave and $120.00 per summer grave and $800.00 per season for Zealand Cemetery, subject to proof of insurance as outlined in the original tender documents.

That the AMO Alert requesting input on the Role of Municipalities in the New Waste Electrical and Electronic Equipment Program (WEEE) be received and the following comments submitted: AMO be advised to lobby for an Environmental Tax on Electronic Goods to be collected Provincially and distributed to Municipalities on a per capita basis with extra consideration for existing waste reclamation projects.

That the information on the Effective Municipal Councillor Training Program 2005 be received and following registered to attend, Janet Gutowski and Logan Murray to attend Module 2 April 21, 2005 at Howard Johnson, Kingston.

That the request from Fire Chief, Mark MacDonald to amend the Fire Department By-law #2003-139 be received and Amendment #1 to change the title of “District Chief” to “Deputy Fire Chief” and “Deputy District Chief” to Assistant Deputy Fire Chief” be approved, Amendment #2 to remove the specific definitions for the Captain’s positions detailed in 6(iv) in the brackets be approved, Amendment #3 to change Section 28 to read: “Promotions shall be in accordance with the department policy and approved by the Fire Chief. Appointment of the Deputy Fire Chief(s) shall be recommended to Council for approval, and adopted by by-law.” Be approved.

That the following be appointed to the Kennebec District Recreation Committee for 2005: Al Scott, Rachel Cahoon, Jerry Izzard, Judy Paddick, Diane Nicolson, Vera Steele, Dora Scott, Helen Praskey, Peter & Rosemary Wadham, Rhonda MacFarland, Rick & Mardi Brown, Si & Pat Tucker, Irene Kirk, Edith Nitsche, Dave & Sheila McCourt, Judy Kennedy, Gloria Smiley and Bill Miles.

That the letter from Beverley Disney, Municipal Relations Representative from the Municipal Property Assessment Corporation (MPAC) confirming that the agreement with the Township does not allow sharing MPAC Parcel Mapping by the municipality and further that the request by Bobs and Crow Lakes Association for boundary line data is also not allowed under the agreement, be received and that a copy of the letter be forwarded to FEP and the Bobs and Crow Lakes Association.

That the resolution form the Township of Frontenac Islands to support in principle the County of Frontenac Strategic Planning Process conditional upon priorities and planning that are forthcoming from the process being area rated back to the benefiting townships be received for information.

That the resolution from the Township of St. Clair to request the Governments of Ontario and of Canada to ensure that the implementation and application of nutrient management rules are done in a way that addresses the concerns the farm community has repeatedly raised; recognize that environmental benefits provided by farmers offset any need for administrative charges on water taking permits; restore confidence of the government/farmer partnership by re-establishing long-term investment in drainage infrastructure and immediately implement an action plan to address the farm income crisis endorsed and the appropriate letters sent.

That the resolution from the Municipality of Kincardine to petition the Province of Ontario to ensure that fair, equitable and sustainable funding is made available to conservation authorities in order to continue to deliver the existing programs and to meet the challenges of the future endorsed and the appropriate letters sent.

That the resolution from the County of Dufferin to request the Minister of Finance and the Minister of Transportation of the Province of Ontario to develop a new formula for the gasoline tax rebate to municipalities, based on a per lane kilometer of roadway, and for both bus and rail transit systems on a per route kilometer basis endorsed and the appropriate letters sent.

That the Accounts Payable reports dated February 11, 2005 in the amount of $68,596.95; February 25, 2005 in the amount of $68,173.40 and March 1, 2005 in the amount of $7,725.02 be approved for payment.

That the funding application under the Eastern Ontario Development Fund, Community Capacity Program to apply for $20,000.00 to conduct a Commercial/Industrial Property Study be approved by the Council of the Township of Central Frontenac and the Mayor and Clerk authorized to sign the application.

That the request form Allan Pyle to use the unopened road allowance at part lot 4, Concession 10, Olden District be received and Approved and by-law presented later in the meeting to stipulate the following conditions: 1. That a plan of survey be prepared and registered at the registry office, Kingston, with a copy deposited with the Township of Central Frontenac to become Schedule “A” to the By-law. 2. That proof of liability insurance be provided to the Township of Central Frontenac yearly protecting the municipality against any liability. 3. That there will be no encroachment or disturbance of abutting properties now or in the future. 4. That Mr. Pyle post a sign at the start of the unopened road allowance stating “Road not assumed by Municipality. Use at your own risk” and that Mr. Pyle ensure the sign is kept posted. 5. That Mr. Pyle provide documentation to the Township of Central Frontenac of any work intended for the unopened road allowance. 6. That any construction on the unopened road allowance will not adversely affect any wetlands or the environment. 7. That the Township of Central Frontenac does not intend to open or assume the aforementioned unopened road allowance or assume any liability for same. 8. That the road be built to the Private Road Standards adopted by the Township of Central Frontenac.
