Township Council Minutes - November 19, 2003

COUNCIL MINUTES - NOVEMBER 17, 2003

 

Council met in regular session Monday, November 17, 2003 at 9:00 a.m. in the Council Chambers, Sharbot Lake.

 

Present:            Mayor Bill MacDonald

                        Deputy Mayor Jack Nicolson

                        Councillors Bob Harvey, Marsden Kirk, Boyce Peters, Faye R. Putnam,

                        Frances Smith and Bill Snyder

 

Absent:            Councillor Elva Price

 

Also in attendance Heather Fox - Clerk Administrator, Bill Nicol - Public Works Manager,

Jay DeBernardi - Fire Chief, Judy Gray - Treasurer/Tax Collector, Sandra Clow - Clerical Assistant and Gazette Reporter.   Ian Trickett attended for the delegations portion of the meeting.

 

Councillor elect, Janet Gutowski also attended.

 

No members of the public attended other than those scheduled on the agenda.

 

There were no disclosures of pecuniary interest.

 

Wayne Moase attended to request permission to use the road allowance between lot 15 & 16, concession 1, Oso District to gain access to a lot created from a natural severance of Part 2 on plan 13R-11544.  The access would not be assumed as a road by the municipality.

Mayor MacDonald presented plaques to Councillors Marsden Kirk and Boyce Peters, and thanked them for their contribution to Council.  Councillor Elva Price will be presented with a plaque at a later date.

 

The following resolutions were presented.

                        That the agenda of November 17, 2003 be adopted as amended.

                        That the minutes of October 28, 2003 be adopted as amended.

                        That the request from Wayne Moase to use the unopened road allowance between

                        lots 15 and 16, Concession 1, Oso District to gain access to a lot created as a result

                        of a natural severance be approved in principle with the understanding that the                                     Township does not intend to assume any road developed on the unopened road

                        allowance and that a by-law be prepared pending notice of written approval from

                        the Conservation Authority, Ministries of Environment and Natural Resources as

                        applicable.

                        That the following accounts payable be approved:

                        October 31, 2003            $2,456.66

                        That the invitation to Council from District #4 Fire Department to participate in the

                        Santa Claus Parade on Sunday, December 7, 2003 at 1:00 p.m. be received and                             accepted.

                        That the request from S. Dwight Dods to postpone the effective date of his omitted

                        assessment be denied with a letter of explanation.

                        That the request from AMO to encourage members to ask the Federal Minister of

                        Environment, the Honourable David Anderson, and the Chairman of the Special

                        Committee of Council, the Honourable Don Boudria, not to proceed with the "final

                        order" that would legally list road salts as toxic, but rather let municipal                                              governments develop and implement Best Practices approaches before considering

                        a "toxic" designation be approved and the appropriate letters sent.

                        That the invoice from the County of Hastings in the amount of $2,524.67 for legal

                        services provided by Peter McAbe in the purchase of the CP rail bed from Havelock

                        to Glen Tay be paid.

                        That the letter from Donald Good on behalf of Mel Conboy, Darren Castleman,

                        Josh Middleton and Lorne Smith regarding fencing of the K & P Trail be received                       and deferred until the legal opinion has been properly reviewed.

                        That a grant of $1,000.00 be forwarded to the Sharbot Lake Lions Club

                        for the Santa Claus Parade.

                        That By-law #2003-147, being a by-law to set the time of the Inaugural Meeting,

                        be read a first and second time.

                        That By-law #2003-147, being a by-law to set the time of the Inaugural Meeting,

                        be read a third and final time and passed.

                        That the correspondence identified under Section 9 of the agenda be received for

                        information.

                        That this Council advise, by registered letter, the County of Hastings and

                        Peter McAbe, that Peter McAbe no longer represents the Township of Central                                     Frontenac in the negotiations to purchase the C.P. rail line, and that our solicitor be

                        directed to represent our interests in this regard.

                        Pursuant to Section 239 (2) of the Municipal Act, 2001 that Council proceed in                                camera to discuss: personal matters about an identifiable individual, including

                        municipal or local board employees.

                        That the In Camera meeting return to regular Council.
