COUNCIL MINUTES

NOVEMBER 26, 2002

Council met in regular session on Tuesday, November 26, 2002 at 9:00 a.m. in the Council Chambers, Sharbot Lake.

Also in attendance Cathy MacMunn - Deputy Clerk, Sandra Clow - Clerical Assistant, Jay DeBernardi - Director of Fire and Emergency Services, Chris Matheson - Coordinator of Special Projects, Jeff Green - Frontenac News reporter, Craig Bakay - Gazette reporter. Ian Trickett - Chief Building Official attended for a portion of the meeting.

No members of the public attended other than those scheduled on the agenda.

There were no disclosures of pecuniary interest.

Brian Ritchie and Kathy Wood attended to update Council on the "Frontenac Centre".

Stan Mika and Paul Warren attended regarding the up-grade to the septic system at the Tip Top Dollar Store on Road 38. They were advised this authority had been delegated to the Health Unit.

That the request from Cindy Warren and Stan Mika for Council's assistance with the health unit's requirement for an upgraded septic system to enable an addition to the Dollar Store be received and filed.

That resolution #445-2002 be rescinded and that since further investigation has revealed that the Ministry of Agriculture will not compensate the municipality for the loss and further that by-law #2001-106 does not allow for the municipality to compensate for the loss of a donkey, the claim not be paid.

That Council recommend approval of the Garrison Shores Condominium Application subject to the following recommended changes as provided by Planning Consultant, Glenn Tunnock:
1. That the Draft Condominium Declaration be modified to include the following clause after the first sentence in Article 1V, clause 4(a): "Alterations or replacement of septic tanks and filter bed systems shall make provision for removal of phosphorus wherever possible using the most current technologies available."
2. That the Draft Condominium Declaration be modified to change 8 m in Article III, Clause 1 (e) to "15m", and the clause modified to read "No owner shall construct any building or structure within the Buffer Zone without the approval of the Municipality."
3. That the Draft Condominium Declaration be modified to incorporate the following (modified wording) "The private roadways within the condominium property shall be kept in good condition and passable for emergency vehicles at all times." It should also be clear in the Condominium Declaration that roads are part of the Common Expenses.
4. That the Draft Condominium Declaration be modified to incorporate the following wording in Article IV; "New development or redevelopment will be done in a manner which does not adversely affect fish habitat; which maintains a biodiversity and the quality of air, land, water and biota; and which maintains as much wood and natural vegetation cover as possible".
5. That the zoning by-law be amended to limit the number of residential units to a maximum of 61 and that recreational vehicles be permitted where they do not exceed one per lot; that the docks and wharves be restricted to a (single) common public docking facility on the lake serving the condominium community; that the minimum lot sizes be fixed as those shown on the Plan of Condominium; and, that the access window to the lake be limited to a maximum of 25% of the lot frontage to a maximum of 9 m. That the lot/site areas for individual residences; i.e. exclusive use areas, be incorporated into Schedule "D" of the Condominium Declaration.
6. That the Draft Condominium Declaration be modified by adding a clause to Article IV that "Residents of the condominium are personally responsible for transporting and depositing any and all domestic waste to the municipal landfill site".

That the request from the Gazette to place business card size ads in two issues of their paper to wish happy holidays and caution on drinking and driving in conjunction with the OPP and MADD at a cost of $50.00 be approved.

That the letter from M.T.O. advising that a sign "to Elm Tree Road" attached to the West Gate Road sign was not approved and also advising that a sign indicating "formerly Elm Tree Road" would be allowed for up to 2 years be received and that Council NOT request M.T.O. to erect a "formerly Elm Tree Road" due to the further confusion this could cause as Elm Tree Road was not re-named in total and a portion of it still exists.

That the agreement to provide mutual aid automatic assistance for Fire Protection Services between the Corporation of the Township of Central Frontenac and the Township of Addington Highlands and the Township of North Frontenac be approved in principle.

That the Township of Central Frontenac enter into an agreement with CGIS to perform all required Road Network mapping, edits and related data maintenance for a monthly fee of $250.00 per month until cut-over and re-negotiate thereafter.
And further that CGIS provide GPSing, as requested at a rate of $400.00 per day (1/2 day minimum, includes post-processing) plus mileage at .41 cents per kilometer; And further that all printed paper maps plotted for the Township of Central Frontenac by CGIS be charged the set fee schedule as set out in the cost structure sections 4 and 5.
